1. Introduction

Welcome to HomeScreen! These Terms of Service ("Terms") govern your access to and use of the services provided by Home Screen Technologies Limited ("HomeScreen," "we," "us," or "our"), including our website, applications, and verification services (collectively, the "Services").

Please read these Terms carefully. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.

Important: These Terms apply to all users of the HomeScreen platform, including landlords, tenants, and property managers.

2. Description of Services

HomeScreen provides a digital platform for tenant verification in Nigeria.

For Landlords/Property Managers ("Landlords")

We offer a service to request and receive comprehensive verification reports on prospective tenants to aid in making informed rental decisions.

For Prospective Tenants ("Tenants")

We offer a secure platform to submit personal, financial, and historical information for the purpose of generating a verification report at the request of a Landlord for a specific rental property.

Important Note: HomeScreen acts as a data processor and verification service provider. The information and recommendations in our reports are provided to assist Landlords.The final decision to enter into a rental agreement with a Tenant rests solely with the Landlord.

3. User Accounts (Landlords)

To use our Services as a Landlord, you must register for an account. You agree to:

  • • Provide accurate, current, and complete information during the registration process.
  • • Maintain the security of your password and accept all risks of unauthorized access to your account and the information contained within.
  • • Promptly notify us if you discover or otherwise suspect any security breaches related to the Services.
  • • Use the information provided in Verification Reports solely for the legitimate business purpose of assessing a Tenant's suitability for a specific rental property and in strict compliance with all applicable laws, including the NDPA.

4. Tenant Application Process

As a Tenant using our Services, you acknowledge and agree to the following:

  • • You will initiate the verification process by using a valid Property ID or QR Code provided to you for a specific rental property.
  • • You will provide information that is accurate, truthful, current, and complete. Providing false or misleading information is a material breach of these Terms and may result in the immediate termination of your verification process and forfeiture of any fees paid.
  • • You will provide explicit consent for HomeScreen to collect, process, and verify your information. This includes contacting third parties such as your employer, previous landlords, and guarantors via automated means (including Email and WhatsApp), and using secure third-party Application Programming Interfaces (APIs) to verify your identity and financial information as detailed in our Privacy Policy.

5. Fees and Payment

Verification Fee

Tenants are required to pay a non-refundable verification fee, as stated at the time of application (currently ₦5,000 Five Thousand Naira), to initiate the verification process. This fee is for the services rendered in collecting data and compiling the verification report.

Payment Processor

All payments are processed through our secure third-party payment gateway, Paystack. HomeScreen does not store your full credit/debit card details.

Non-Refundable

Once the verification process has commenced (i.e., after successful payment), the fee is non-refundable, regardless of the outcome of the verification (successful or unsuccessful) or the Landlord's final rental decision.

6. Acceptable Use Policy

You agree not to use the Services to:

  • • Submit false, misleading, fraudulent, or inaccurate information.
  • • Engage in any illegal, fraudulent, or harmful activities.
  • • Impersonate any person or entity or misrepresent your affiliation with a person or entity.
  • • Violate the privacy or data protection rights of others, including submitting referee or guarantor information without their consent.
  • • Attempt to decipher, decompile, disassemble, or reverse-engineer any of the software used to provide the Services.
  • • Use the information provided by the Service for any purpose other than its intended and legitimate use (i.e., tenant screening for a specific rental property).
  • • Harass, abuse, or harm another person through the use of the platform.

7. Intellectual Property

All content, trademarks, logos, and software on the HomeScreen platform are the exclusive property of Home Screen Technologies Limited and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes as intended by these Terms. You may not use our intellectual property for any other purpose without our express written consent.

8. Disclaimers and Limitation of Liability

"As Is" Service

The Services and Verification Reports are provided on an "as is" and "as available" basis. While we strive for accuracy, HomeScreen does not warrant that the information obtained from third parties (including government databases, financial institutions, employers, or previous landlords) is free of errors or inaccuracies. We are not responsible for the truthfulness of responses from referees.

No Guarantee

We do not guarantee the future performance of any Tenant or the suitability of any rental property. The Verification Report is an informational tool to assist Landlords, not an endorsement or guarantee of a Tenant's character or future conduct.

Limitation of Liability

To the fullest extent permitted by law, Home Screen Technologies Limited, its affiliates, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Services; (b) the conduct or content of any third party on the Services; or (c) the final rental decision made by a Landlord. In no event shall HomeScreen's aggregate liability for all claims relating to the services exceed the amount you paid us for the specific Service in question.

9. Dispute Resolution

Any dispute arising from or relating to these Terms or the Services shall first be addressed by contacting our support team at hello@homescreen.ng. If a resolution cannot be reached amicably, the dispute shall be resolved through binding mediation administered in Lagos, Nigeria, or, failing that, in the competent courts of Lagos State, Nigeria.

10. Termination

We may suspend or terminate your access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

11. General Provisions

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law principles.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our site and updating the "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeScreen regarding our Services.
